Filing an SR-22 After A License Suspension

Depending on the circumstances and the State that you live in, you may be required to file an SR-22 Certificate following a license suspension.  Your State’s Department of Motor Vehicles will determine when you must submit an SR-22 also known as Proof of Financial Responsibility.  Despite it commonly being referred to as SR-22 insurance, it is not a type of insurance but rather a certificate provided by a licensed insurance company.  It is imperative that if you are required to file an SR-22, you do so as quickly as possible and NEVER operate a motor vehicle unless adequately licensed and insured.

When An SR-22 Certificate of Financial Responsibility is Required

There are several reasons that a Department of Motor Vehicles may require a person to file proof of financial responsibility.  Some of the most common requirements include:

  • A license suspension related to Driving Under the Influence (DUI) or Driving/Operating While Intoxicated (DWI/OWI)
  • Driving without Insurance
  • Driving without a license
  • Driving on a Revoked or Suspended License
  • Repeat Traffic Offender or too many driving points
  • Causing an accident while not maintaining proper insurance

Reinstating Your Driving Privileges

The Department of Motor Vehicles will not reinstate your driving privileges until you have met all conditions required by state law.  In addition to filing an SR-22, you may have to enroll in or complete an alcohol education program, pay reinstatement fees, or serve a mandatory suspension period before you may reapply for your driving privileges.  Generally, you are required to keep an SR-22 Certificate on file for a minimum of three years.  Failure to maintain proof of responsibility for the mandatory period will result in your license being suspended.
